How the Supreme Court Decision Hartman v. Moore Protects Parents from CPS Retaliation

The Truth Parents Need to Know

When parents speak up against injustice, file complaints, or expose misconduct in child welfare agencies, they often face retaliation. They are threatened, ignored, or even see their children taken away as punishment for speaking out.


What most parents do not know is that the United States Supreme Court already ruled that this kind of retaliation is unconstitutional. The highest court in the country made it clear that when government officials punish you for using your voice, they are breaking the law.


The Case That Changed Everything: Hartman v. Moore (547 U.S. 250, 2006)

In this historic case, a citizen named William Moore was falsely targeted by government investigators after he criticized public officials. They pushed for criminal charges against him not because of evidence, but because he spoke out.

The Supreme Court stepped in and ruled that:

“A vengeful government officer is subject to damages when retaliation for protected expression is the but for cause of an injurious action.”

This means that if a government employee such as a prosecutor, investigator, or social worker takes harmful action against you because you exercised your First Amendment rights, that is illegal retaliation.


What This Means for Families Facing CPS or DCFS

The Hartman decision applies to every level of government, including child protective services and county agencies. Here is what it means for parents and families.

  1. You have the right to free speech. You can speak publicly about your case, advocate for your children, and expose misconduct.

  2. You have the right to seek help. Whether you work with a lawyer, nonprofit, or advocate, it is your right to associate with others to pursue justice.

  3. The government cannot punish you for either. If CPS, DCFS, or county attorneys retaliate by removing your children, blocking visits, or threatening you, that is a constitutional violation, not a policy matter.

  4. Officials can be held accountable. Under 42 U.S.C. Section 1983, you can bring a lawsuit against public officials who retaliate against you for exercising your rights.


Why I Teach This to Parents

In my own federal case Patrick v. County of Los Angeles, I have witnessed the same type of retaliation that the Supreme Court condemned in Hartman v. Moore (Click).


Officials retaliated against parents and advocates for exposing the truth. They used fear, court manipulation, and removals to silence families who were standing up for justice.


That is why I founded Stolen Children by CPS, to help parents understand the law that protects them. When I teach families about Hartman v. Moore, I am not speaking about theory. I am speaking about real protection written in the Constitution.


When you expose government misconduct and they strike back, you are standing exactly where the Supreme Court said justice must prevail.
