ADA Rights for the Deaf Community: Demand Certified ASL & CDI Interpreters
At Stolen Children by CPS, we stand firm in advocating for Deaf parents and children who face discrimination due to unqualified and uncertified interpreters in legal, medical, and social services settings. The Americans with Disabilities Act (ADA) requires government agencies, including Child Protective Services (CPS), courts, and hospitals, to provide qualified and certified interpreters—not just anyone who "knows some sign language.
✅ Ensure Accuracy – Misinterpretations in legal and CPS cases can lead to wrongful child removals and unjust rulings (CDI SPP, 1997).
✅ Follow Strict Confidentiality Rules – Unlike unqualified interpreters, certified professionals must adhere to confidentiality under the NAD-RID Code of Professional Conduct (Multiple Roles SPP, 2007).
✅ Understand Legal and Cultural Nuances – Certified interpreters do not just sign words; they ensure that Deaf culture, legal terminology, and language variations are accurately conveyed (Professional Sign Language Interpreting SPP, 2007).
Unqualified Interpreters Cause Harm
🚫 They make critical errors that distort testimony and evidence in court (Legal Interpreting SPP, 2007).
🚫 They break confidentiality, risking legal consequences and personal safety (Multiple Roles SPP, 2007).
🚫 They fail to accommodate Deaf consumers, violating ADA protections (Professional Sign Language Interpreting SPP, 2007).
Your ADA Rights: Demand Certified Interpreters
Under the ADA and Section 504 of the Rehabilitation Act, you have the right to request and receive:
🔹 Certified Deaf Interpreters (CDIs) when standard ASL is not effective (CDI SPP, 1997).
🔹 Certified legal interpreters (SC:L) for court or CPS meetings (Legal Interpreting SPP, 2007).
🔹 A team of interpreters for long or complex legal proceedings (Team Interpreting SPP, 2007).
DO NOT accept uncertified interpreters! If an agency refuses to provide a RID-certified interpreter, file a complaint with the Department of Justice (ADA.gov) and demand compliance.
