When a parent dares to speak the truth about CPS, retaliation often follows. Marissa Hernandez stood up as a parent advocate. She helped other families, she exposed corruption, and she refused to stay silent. In return, DCFS punished her the only way they know how, by taking her children.
Marissa’s juvenile court cases 21CCJP02742E and 21CCJP02742F show how Los Angeles County moved to silence her. They monitored her speech, issued nondissemination orders, and punished her for advocacy. They turned her love for her children into a weapon against her. That is not child protection. That is retaliation.
When I filed evidence of this in my federal case, the counties tried to strike it. They wanted the judge to erase Marissa’s story from the record, to hide her truth and bury her pain. But once evidence is placed on the public docket it cannot be erased. The judge declined their motion to remove it. The story remains.
This ruling is more than legal procedure. It is a recognition that what happened to Marissa is not a secret and not a scandal to be swept away. It is part of the history of government misconduct. Cases like Henry v County of Shasta and Kamakana v City and County of Honolulu make it clear that embarrassment is not a reason to seal evidence. The public has the right to know.
Marissa’s story is not just about one mother. It is about what happens to all of us when the system retaliates against those who dare to expose the truth. If they can take her children for speaking out then no parent is safe. If they can silence her voice then every family is at risk.
They tried to erase her. The court said no. The truth remains and it is stronger than ever.
This is not only my fight. This is Marissa’s fight. This is your fight. This is every parent’s fight. Together we stand against a system that uses fear and retaliation instead of justice. Together we prove that no matter how hard they try to silence us, the truth will always rise. Under the sealed Dkt. 240 by Federal Judge's order.
